1. Who must register on the NYS Sex Offender Registry?

If you were convicted of a registerable sex offense or sexually violent offense on or after January 21, 1996 you must register;

OR

If you were convicted of a registerable sex offense before January 21, 1996 and you were on parole or probation or incarcerated on January 21, 1996, you must register.

2. How do I register as a sex offender?

If you are in jail or prison for a New York crime, you will be registered by the jail or prison 15 days prior to being released.

If you are sentenced to probation, released upon the payment of a fine, or conditionally or unconditionally discharged for a New York crime, you will be registered by the sentencing court.

If you were convicted in another jurisdiction and reside or plan to reside in New York, you will be registered by the Division of Criminal Justice Services (DCJS). You must notify DCJS at the address listed below under #15.

3. Do I need to report where I live?

Yes. Each year, DCJS will mail a Sex Offender Registry Address Verification Form to your last listed address. You must sign and return the annual verification form to DCJS within 10 days after receiving it. If the Form is not signed, it will be returned to you for signing. If the post office returns the Form to DCJS or you do not sign and return the Form to DCJS, your local police department will be notified that you didn’t submit the required Form.

In addition, if you are a level 3 sex offender or the court determined that you are a sexual predator, you must go to the local police department every 90 days to personally report your address.

4. What if I am in jail or prison?

If you are in jail or prison, you must notify DCJS. When in jail or prison, you still must comply with your sex offender obligations. This includes returning the Annual Verification Form to DCJS. When you leave jail or prison, you must notify DCJS of the address where you are going to live. If you are a level 3 sex offender or a sexual predator, and you are in jail or prison, the only obligation that you do not have to do is go to the local police department in person every 90 days to verify your address.

5. What do I need to do if I move?

You must notify DCJS in writing of your new address no later than 10 days after moving. Forms to change an address are available through DCJS or at local police departments. Probation and parole officers also have copies of these forms. You also can write a letter to DCJS. You must sign the form or your letter and say where you lived and to where you are moving.

Note: The law requires that you provide your exact address such as a house or apartment number and the name of the street or road. (Not a Post Office Box address).

6. Do I need to provide a picture of myself?

Yes. If you are a level 1 or a level 2 sex offender, you must personally report to your local police agency every 3 years to have a current photograph taken. If you are a level 3 sex offender, you must go to your local police department every year to have a photograph taken.

You will receive a notice from DCJS around the time you are required to report to your local police agency.

7. For how long must I register as a sex offender?

You must register for the rest of your life if you are:

  • Designated a sexual predator, a sexually violent offender or a predicate sex offender, OR
  • Classified as a risk level 2 or risk level 3.

You must register for 20 years if you are:

  • A level 1 sex offender and you are not designated a sexual predator, a sexually violent offender or a predicate sex offender.

8. Can I move to another state or country?

Yes, you can move to another state or country but you must notify the local police department of the new state or country that you are moving into the area. That state or country will determine whether you need to register as a sex offender there.

Registration requirements do not end when you move to another state and you must notify DCJS of your new address. You will not be removed from the New York State Sex Offender Registry.

9. Can I move to New York if I am a registered in another state?

Yes, you may move to New York State but you must notify DCJS within 10 days after moving to New York State. Your notification should include your name, date of birth, social security number, telephone number, current address and any proposed new address, date of arrest, date of conviction, crime of conviction, jurisdiction of conviction and sentence received, and should be sent to the New York State Division of Criminal Justice Services, Sex Offender Registry, 4 Tower Place, Albany, N.Y. 12203.The New York State Board of Examiners of Sex Offenders will determine if you must register in New York State. If you need to register, you must register with DCJS by signing a Sex Offender Registration form.

10. Do I need to report that I am attending or working at a school?

Yes, you must notify DCJS of the name and address of the school no later than 10 days after you enroll, start attending or working at the school. This includes two and four year colleges, universities and vocational schools.

You also must notify DCJS if you plan on living in a dorm, apartment, or house owned by the school.

Within 10 days after you are no longer enrolled at, residing at, attending or employed at a school you must notify DCJS.

11. Am I required to report employment information?

If you are a level 3 sex offender, you are required to give DCJS the name and address of your employer. You should notify DCJS in writing of any changes in your employment.

12. Do I have to report motor vehicle information?

Yes, you are required to report to DCJS your driver’s license number and the state where the license was issued. Additionally, you need to provide information about any motor vehicle you own or use.

The information you report should include: Vehicle owner's name, license plate number, issuing state, and the vehicle year, make, model and color.

13. Do I have to report internet information?

Yes. You are required to report to DCJS all your internet accounts and e-mail addresses and screen names used by you for the purposes of chat, instant messaging, or social networking. If you change internet information, you must notify DCJS no later than 10 days after the change.

14. What will happen if I do not comply with registration requirements?

If you do not comply with registration requirements, you are committing a crime. The first offense is punishable as a class E felony and a second or subsequent offense is a class D felony.
